The International Register of Damage for Ukraine has expanded the opportunities for documenting losses caused by Russian aggression by opening new claim categories for both individual entrepreneurs and businesses. These include category A3.5 “Loss of Sole Proprietorship” for individual entrepreneurs and categories C1.1, C1.2, and C3.1 for legal entities, enabling the documentation of infrastructure damage and asset losses.
Individual Entrepreneurs: Category A3.5 “Loss of Sole Proprietorship”
On 10 March 2026, the Register of Damage for Ukraine announced the launch of category A3.5, allowing individual entrepreneurs to document lost income resulting from the forced suspension of, or inability to carry out, business activities (https://surl.li/elwfjg).
Claims are submitted through the Diia portal.
In accordance with Procedure No. 365, the claimant provides information on the registration of the individual entrepreneur, the type of business activity, the place of business, the circumstances and date of the loss of business activity, the amount of expected compensation, and other relevant information. Evidence supporting the loss of sole proprietorship may include the individual entrepreneur’s financial statements for the years preceding the loss, contracts, or tax reporting documents.
Claims may be submitted by individual entrepreneurs who lost income after 24 February 2022 as a result of the internationally wrongful acts of the Russian Federation on the territory of Ukraine. In this context, the loss of sole proprietorship means the loss of income due to the forced suspension of business operations or the inability to conduct business.
Important: The Register does not make decisions on compensation and does not pay compensation. It only records claims for a future international compensation mechanism.
Legal Entities: Categories C1.1, C1.2, and C3.1
Since 29 April 2026, businesses have been able to submit claims under three categories:
- C1.1 – Damage to or destruction of critical infrastructure
- C1.2 – Damage to or destruction of non-critical infrastructure
- C3.1 – Damage to, destruction of, or loss of assets
Claims are submitted through the Diia portal (the respective services for categories C1.1, C1.2, and C3.1).
Category C1.1 and C1.2 cover claims for the value of destroyed property or the cost of repairing or restoring infrastructure damaged after 24 February 2022. Critical infrastructure includes the energy, water supply, transport, healthcare, finance sectors, and other systems essential to the functioning of the state.
Category C3.1 allows claims for the loss or destruction of assets and related damages, including lost profits arising from such assets. Assets may include, among others, real estate, equipment, vehicles, inventory, funds, contractual rights, and intellectual property.
In all categories, claimants provide information about the company, a description of the incident, the extent of the damage, an assessment of losses, and supporting evidence, including documents, financial statements, photographs, videos, and expert assessments.
Important Context
The Register of Damage is not a judicial body and does not make decisions regarding compensation. Its function is to collect and organize claims. All submitted materials will be transferred to a future international compensation mechanism, which has yet to be established. That mechanism will make decisions on compensation.
The new RD4U categories therefore create the first structured international instrument for documenting the losses of Ukrainian businesses, both individual entrepreneurs and legal entities.
