VAT Exemptions on Energy Equipment Imports Extended for 2026-2028

On December 3, 2025, the Verkhovna Rada of Ukraine supported in its second reading and as a whole Draft Law No. 14097 “On Amendments to the Tax Code of Ukraine Regarding the Peculiarities of Corporate Income Taxation for Banks in 2026.”

In addition to bank profit taxation, the provisions of this law provide for the extension of the import tax exemptions for energy equipment for the period of 2026-2028.

This refers to the VAT exemption for the import of equipment for wind power plants, solar power plants, energy storage systems, gas-piston, and gas-turbine generation. This decision will reduce the cost of implementing energy projects, stimulate infrastructure modernization, and strengthen the country’s energy resilience during the war.

How the Initiative Was Formed

The provision to extend these benefits was originally part of Draft Laws No. 14089 and No. 14090, which the Union of Ukrainian Entrepreneurs (SUP) actively supported. These specific bills envisioned the extension of the preferential tax regime for energy equipment imports and the expansion of the list of eligible goods, particularly equipment for wind power stations.

Since the existing exemption was set to expire at the end of 2025, the decision was made to implement it through another bill that could be passed within a shorter timeframe.

The Role of SUP in Promoting the Decision

The Union has consistently advocated for the necessity of extending these benefits and lowering the cost of access to critical energy equipment. Specifically, official appeals in support of Draft Law No. 14089 were sent to the Ministry of Economy, the Ministry of Environmental Protection and Natural Resources, the Ministry of Agrarian Policy and Food of Ukraine, the Verkhovna Rada Committee on Finance, Taxation, and Customs Policy, and other relevant ministries.

In its appeals, the Union emphasized the importance of maintaining current exemptions, as access to essential energy equipment allows both businesses and the state to restore energy infrastructure destroyed by the war more quickly while simultaneously developing new renewable energy projects. Furthermore, SUP supported the advocacy campaigns of business and expert communities that highlighted the need to stimulate investment in renewable energy.

Why It Matters

This parliamentary decision paves the way for new investment projects in the energy sector, lowers the cost of modernizing production facilities, and accelerates the restoration of damaged infrastructure. Extending the exemption until 2028 will be a significant contribution to strengthening Ukraine’s energy security.
