User Agreement

This User Agreement (hereinafter referred to as the “Agreement”) governs the relationship regarding the use of the Site’s functions and the general terms of potential service provision between the Performer (hereinafter referred to as the “Site Owner”), on the one hand, and the individual or legal entity, the Customer, who has accepted the terms of this Agreement by joining this Agreement in full and unconditionally (hereinafter referred to as the “Site User”), on the other hand, hereinafter collectively referred to as the “Parties,” and individually as a “Party.” This Agreement and the relations between the Parties arising from this Agreement are governed by the law.

General Provisions of the User Agreement

The following terms and definitions shall apply in this document and in the related relations of the Parties:

Site Owner’s Site/Site — the website located on the Site Owner’s domain and its subdomains.
Agreement — this agreement with all additions and amendments.
Site Administration/Site Owner’s Representative – a person authorized by the Site Owner to perform actions provided for in the Agreement.
Visitor — any person who has accessed the Site and is on it, using its features to familiarize themselves with the content posted on the Site.
User — a capable individual who has joined this Agreement for their own interest or acts on behalf of and in the interests of a legal entity they represent.
Any visitor to the Site may voluntarily fill out the provided form and become a User.
The Site contains information and materials about goods and services that may subsequently be provided to the User if a real Agreement is concluded. If an individual has registered as a User on behalf of a legal entity authorized by it, this means that the legal entity accepts the Agreement in full with the following consequences.
In particular, when using the Site, the User shall not have the right to impersonate another person or representative of an organization and/or community without sufficient rights, including the Site’s employees, as well as to use any other forms and methods of unlawful representation of other persons on the Internet, as well as to mislead Users, the Site and its representatives regarding the properties and characteristics of any subjects or objects.
In case of any violation of rights and/or interests in connection with the use of the Site, including by another User, the Site Owner should be notified by sending a written notification, a telephone message with a detailed description of the circumstances of the violation and/or a hyperlink to the page containing the page materials that violate the relevant rights and/or interests of the Site.

Intellectual Property Rights

All materials accessible through the Site, including design elements, text, graphics, illustrations, videos, computer programs, databases, music, sounds, and other materials posted on the Site, are subject to the exclusive rights of the Site and other rights holders. The Site grants the User the right to use its functionality within its general functional capabilities.

The use of the Site in other ways, including by copying (reproducing) the Content posted on the Site, as well as design elements, computer programs, and databases that are part of the Site, their decompilation, modification, and further distribution, public display, making available to the public, is strictly prohibited, unless otherwise provided for in this Agreement and concluded Agreements.

The User has no right to reproduce, repeat and copy, sell, or use for any commercial purposes any part of the Site (including Content available to the User through Applications), or access to them, except in cases where the User has obtained such permission from the Site/Site Owners, or when this is expressly provided for in additional documents (Agreements, Addenda, etc.).

The User’s use of the Site, as well as the Content posted on it, for personal non-commercial use is allowed provided that all copyright laws, related rights, trademarks, other notices of authorship are observed, the author’s name (or pseudonym) / copyright holder’s name is preserved in unchanged form, and the relevant object is preserved in unchanged form. Exceptions are cases expressly provided for by the legislation governing the general protection of data or by additional documents on the use of the Site.

The Site may contain links to websites on the Internet (third-party sites). These third parties and their content are not verified by the Site for compliance with any requirements (accuracy, completeness, etc.). The Site is not responsible for any information, materials posted on third-party sites that the User accesses in connection with the use of the Site, as well as for the availability of such sites or information and the consequences of their use by the User.

Links (in any form) to any site, product, service, any information of a commercial or non-commercial nature posted on the Site do not constitute an endorsement or recommendation of such products (services, activities) by the Site, except in cases where the Site expressly indicates this.

Notifications

The Website Owner/Administration/Representative and persons represented by the Website have the right to send informational e-mail messages to the User to the e-mail address, telephone number, link to the page in social networks specified by the User about events occurring within or in connection with the Website and persons represented by the Website.

Final provisions

This Agreement shall be governed by and construed in accordance with applicable laws governing general data protection. Any issues not regulated by this Agreement shall be resolved in accordance with the law. All possible disputes arising out of the relations governed by this Agreement shall be resolved in accordance with the procedure established by applicable law.

If, for any reason, one or more provisions of this Agreement are found to be invalid or unenforceable, this shall not mean that the remaining provisions of the Agreement are invalid or inapplicable.

Temporary inactivity on the part of the Website in case of violation of the provisions of the Agreements by the User or other Users does not deprive the Website of the right to take appropriate actions to protect its interests later, and does not mean that the Website has waived its rights in the event of such or similar violations in the future.

All disputes under or in connection with the Agreement shall be settled in court at the location of the Website in accordance with applicable law.

This USER AGREEMENT is developed and operates within the framework of the current legislation on the protection of individuals regarding the processing of personal data and the free movement of such data.

This Policy is an integral part of the User Agreement (hereinafter referred to as the “Agreement”) posted and/or available on the Internet on the Website’s domain, as well as other agreements concluded with the User or agreements that may be concluded with the User.

By using the services of the Site, the User agrees to the Privacy Policy of personal data of the Site (hereinafter referred to as the Privacy Policy), and voluntarily and in their own interests gives written consent to the following methods of processing Personal Information: collection, recording, systematization, storage, clarification (updating), change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction for the purposes established by this Policy with or without the use of automation tools. In case of disagreement with the terms of the Privacy Policy, the Client/User shall not send personal data by filling out the relevant forms.

The Privacy Policy applies to all personal information that the Website may receive about the Client/User while using the Website, programs and products of the Website.

Purposes of collecting personal information of the user

The Website may use the personal data of the Client/User in order to:

Identification of the User registered on the Website.
Providing the User with access to the resources of the Website and the Website’s partners.
Establishing feedback with the User, including a phone call, sending notifications, requests for the use of the Site, the provision of services, processing requests and applications from the User, sending advertising and other information about promotions and other services of the Site.
Determining the location of the User to ensure security and prevent fraud.
Confirmation of the accuracy and completeness of personal data provided by the User.
Providing the User with effective customer and technical support in case of problems related to the use of the Website.
Providing the User with service updates, special offers, pricing information, newsletters and other information on behalf of the Website or on behalf of the Website’s partners.

Carrying out advertising activities of the Website

Providing the User with access to the websites or services of the Website’s partners in order to obtain products, updates and services.

Collected information (Personal information)

We collect the following information:

Technical information automatically collected by the Website software during your visit to the Website.
Personal information provided by you when filling out the appropriate form or information received by the Site through the use of social networks by the User.
Other information – provided by the user at his/her discretion.

Technical information

When you visit the Site, information from standard server logs automatically becomes available to the Site administration. This includes the IP address of your computer (or proxy server, if it is used to access the Internet), the name of your Internet service provider, domain name, browser type and operating system, information about the site/social media page from which you came to the Site, the pages of the Site that you visit, the date and time of these visits, files, cookies. This information is analyzed by us in an aggregated (impersonal) form to analyze the traffic to the Site and is used to develop proposals for its improvement and development. The connection between your IP address and your personal information is never disclosed to third parties, except when you have given your consent and/or when required by law.

Technical information about visits to the Site (anonymized) is also collected by statistics counters installed on the Site.

Obligations of the parties

The User is obliged to:

Provide information about personal data necessary for using the Website under the Agreement or concluding the Agreement.
In case of concluding the Agreement with the Website Owner, update and supplement the provided information about personal data in case of changes in this information.

The Administration/representative of the Website / Website Owner is obliged to:

Use the information received solely for the purposes specified in this Privacy Policy.
Ensure the storage of confidential information, not to disclose without the prior permission of the User, as well as not to sell, exchange, publish or disclose in any other possible way the transmitted personal data of the User. The User’s personal data may be stored within the terms and/or transferred to the authorized state authorities only on the grounds and in the manner prescribed by law.
To take precautions to protect the confidentiality of the User’s personal data in accordance with the procedure usually used to protect this kind of information in the existing business environment.
To destroy or block personal data related to the relevant User from the moment of application or request of the User or his legal representative or authorized body for the protection of the rights of personal data subjects for the period of verification, in case of detection of inaccurate personal data or illegal actions.

Personally provided personal information

For the purpose of concluding the Agreements, the User may also provide the following personal data about himself/herself or about the organization and its representatives in whose favor he/she acts: name, patronymic, surname, position, telephone number (additionally, the name, corporate registration data (company code, tax number), registration address and postal address of such organization, corporate telephone number, current account, name of the servicing bank, and correspondent account, etc.) This information about the organization is not personal data.

Protection of collected information

The Website takes all necessary and sufficient organizational, technical and other precautions to protect the confidentiality of Users’ data. Only those employees of the Site who need to perform work functions that require access to personal data have access to information about Users.

The User acknowledges that in case of negligence of the User’s own attitude to the safe storage of personal data, which gives access to them, third parties may gain unauthorized access to them. The Website shall not be liable for any damages caused by such access. We recommend that Users use complex passwords consisting of numbers and letters.

Additional terms and conditions

The administration/representative of the Site / Site Owner has the right to make changes to this Privacy Policy without the consent and without notifying the User. The User assumes responsibility for familiarizing themselves with the updated version of the Privacy Policy, which governs the rules for using the Site. Changes to the Privacy Policy shall take effect from the moment it is posted on the Website, unless otherwise provided by the new version of the Privacy Policy.

The current version of the Policy is available on the Contractor’s Website and its subdomains on the Internet.

This PRIVACY POLICY is developed and operates within the framework of the current EU legislation on the protection of individuals regarding the processing of personal data and the free movement of such data.
