Compensation for business losses: how to submit a claim to the International Register of Losses

Protecting business interests during wartime is one of the key priorities of our work.

The issue of compensation for property lost due to Russian aggression affects thousands of Ukrainian entrepreneurs. This is why the Union of Ukrainian Entrepreneurs (SUP) is working to ensure that businesses have clear answers and real tools for protection.

The Union sent an official inquiry to Yuliia Svyrydenko regarding the operations of the international Register of Damage and the feasibility of Ukrainian companies submitting claims. This initiative was triggered by an inquiry from one of our members seeking a solution for compensation for property lost in temporarily occupied territories. In response, we received a clarification from the Ministry of Justice of Ukraine. It contains practical information for Ukrainian companies that have suffered losses as a result of the Russian Federation’s aggression.

What is the international Register of Damage?

The Register of Damage for Ukraine (RD4U) is an international mechanism established in May 2023 by a decision of the Council of Europe. Its goal is to record and, in the future, provide compensation for damages caused to individuals, businesses, and the state of Ukraine since February 24, 2022.
Until the end of 2025, submitting claims was only possible for individuals. Now, such applications are becoming available for legal entities as well. Access for filing claims under various categories will be opened in stages.

Which categories are already available in test mode for legal entities?

The Ministry of Justice reports that the “Procedure for submission of claims to the international Register of Damage by legal entities and the state of Ukraine” (approved by Cabinet of Ministers Resolution No. 365 dated March 29, 2024) provides for the submission of claims in the following categories (within Category C):

  • C1.1 – Destruction or damage of critical infrastructure
  • C1.2 – Destruction or damage of non-critical infrastructure
  • C1.3 – Damage to residential premises
  • C1.4 – Damage to common areas
  • C1.5 – Damage to non-residential property (not related to business activities)
  • C3.1 – Damage, destruction, or loss of assets
  • C3.2 – Loss of control over property in occupied territories

Other subcategories — such as business relocation (C3.3) and other economic losses (C3.4), among others — will be added later. Currently, access for legal entities is being opened only for a portion of these claims (C1.1, C1.2, and C3.1).

How to file a claim?

Through the Diia portal. The application is submitted by the head of the legal entity (as listed in the Unified State Register) or an authorized representative.
